Get Ready for Major Changes to the DBE Program!

On April 9, 2024, the United States Department of Transportation (USDOT) issued a final rule that modernized the Disadvantaged Business Enterprise (DBE) program and the Airport Concessions DBE (ACDBE) program regulations. These changes will go into effect on May 9, 2024.

Join the Colorado Unified Certification Program (UCP) for an overview of the major changes to eligibility, certification, and counting, and how they will affect currently DBE certified firms, prospective DBE firms, and other minority/woman-owned businesses. These updates are critical to anyone working on Colorado Department of Transportation (CDOT) projects or other federally-assisted local agency contracts for highway, transit, and/or aviation projects.

This webinar will specifically cover changes to the DBE program (not ACDBE) including:

  • Updates to Personal Net Worth Limits and exclusions
  • Major changes to the interstate DBE certification process
  • New processes allowing non-home state's to decertify DBEs
  • Allowances for companies to cure certain defects during the application process
  • Amendments to the factors considered when determining if an individual controls a company
  • Updates to the factors considered when determining control and independence
  • Changes to the "ability to accumulate substantial wealth analysis"
  • Requirement for DBE Performance Plan on Design-Build projects
  • Updates to the rules for counting DBE material suppliers
  • Enhanced requirements for CUF and contractor reporting
  • Specification of prompt payment flow down to all lower tier subcontractors
  • Enhancements to the UCP DBE Directory

  • Jun Arcilla, CDOT DBE Program Manager and Unified Certification Program (UCP) Representative
  • Elly Bacon, City and County of Denver Director, DSBO Certification, UCP Representative
